These Terms of Service ("Terms") govern your use of whereismyai ("whereismyai", "the App", "we", "us", or "our").

By installing, accessing, or using whereismyai, you agree to these Terms. If you do not agree with these Terms, do not use the App.

ABOUT WHEREISMYAI

whereismyai is a free, open-source mobile application that allows you to download and run supported open-source AI models directly on your own device.

The App is designed to provide local AI features, including:

• Downloading supported models from available model sources.
• Running supported GGUF models on-device.
• Text conversations with locally running models.
• Image and vision-model interactions where supported.
• Multiple conversations and conversation history.
• Model-specific generation settings.
• Local storage of conversations, models, attachments, and application preferences.
• Offline AI use after required models and resources have been downloaded.

The App is provided free of charge. There is no subscription, no purchase, no account, and no whereismyai server.

LICENSE AND OPEN SOURCE

whereismyai is open-source software licensed under the Apache License, Version 2.0.

The Apache License 2.0 governs your rights to the whereismyai source code, including the rights to use, modify, and redistribute it, subject to that license's conditions.

These Terms govern your use of the App as distributed through an app store or as a prebuilt binary. Where these Terms and the Apache License 2.0 differ in respect of the source code, the Apache License 2.0 governs the source code.

Third-party libraries, models, and other components are distributed under their own separate licenses.

A copy of the Apache License 2.0 is included with the source code.

ELIGIBILITY AND AGE

You may use the App if you are legally permitted to do so under the laws applicable to you.

You should be at least 13 years old to use the App, or older if the law where you live sets a higher minimum age for using online services.

The App does not filter model output, and models can produce unfiltered or age-inappropriate content. If you are a minor, you should use the App with the involvement and permission of a parent or legal guardian.

AI MODELS AND THIRD-PARTY CONTENT

whereismyai provides access to AI models hosted by third parties, including models available through Hugging Face.

We do not create, own, control, endorse, or vet those models.

Each model may have its own:

• License.
• Terms of use.
• Usage restrictions.
• Attribution requirements.
• Safety requirements.
• Acceptable-use requirements.

You are responsible for reviewing and complying with the license and terms applicable to any model you download or use.

The availability of a model through whereismyai does not mean that we grant you any rights to that model beyond the rights provided by its applicable license.

A model is third-party code and data that runs on your device. You are responsible for deciding whether you trust a model and its publisher before downloading it.

MODEL OUTPUTS

AI-generated responses may be inaccurate, incomplete, misleading, biased, offensive, or otherwise unsuitable.

The App applies no content filtering or moderation to model output.

You are responsible for evaluating AI-generated content before relying on it.

Do not rely on outputs from the App as a substitute for professional medical, legal, financial, safety, or other professional advice.

You are responsible for how you use generated content, including whether your use complies with the law and with the license of the model that produced it.

DEVICE REQUIREMENTS AND PERFORMANCE

Running AI models locally can require significant CPU, GPU, RAM, storage, battery power, and thermal capacity.

Model performance depends on the device, operating system, model architecture, quantization, context size, runtime, and other factors.

A model that can be downloaded may not necessarily run, or run well, on every device.

Using large or incompatible models may cause:

• Slow performance.
• Increased battery consumption.
• Increased device temperature.
• Application termination by the operating system.
• Out-of-memory conditions.
• Reduced available storage.
• Other device or application instability.

Loading a model that is too large for your device can cause the App to be terminated by the operating system. This is a limitation of running large models on mobile hardware.

You are responsible for choosing models appropriate for your device.

STORAGE AND DOWNLOADS

The App may download large model files and associated resources to your device.

You are responsible for ensuring that your device has sufficient storage and network connectivity for downloads.

Downloaded models may consume several gigabytes of storage each.

You may delete downloaded models through the App.

We are not responsible for mobile data charges, network charges, storage shortages, or other costs resulting from downloads.

OFFLINE OPERATION

After a model has been downloaded, the core inference experience is designed to operate locally on the device without requiring network access.

Discovering and downloading models from external services requires network connectivity.

YOUR CONTENT

You are responsible for content that you enter into the App, including prompts, conversations, images, and other material.

Your content stays on your device. We do not receive it, host it, or moderate it.

You must not use the App to violate applicable law or the rights of others.

You should not submit highly sensitive information to an AI model unless you understand the risks associated with doing so.

THIRD-PARTY SERVICES

The App may interact with third-party services, repositories, libraries, runtimes, or infrastructure.

Third-party services are governed by their own terms, licenses, and privacy policies.

We are not responsible for the availability, accuracy, security, or continued operation of third-party services, including the continued availability of any model or model repository.

NO WARRANTY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHEREISMYAI IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT GUARANTEE THAT:

• THE APP WILL ALWAYS WORK WITHOUT ERRORS.
• THE APP WILL WORK ON EVERY DEVICE.
• EVERY MODEL WILL BE COMPATIBLE WITH YOUR DEVICE.
• AI OUTPUTS WILL BE ACCURATE OR RELIABLE.
• THE APP WILL ALWAYS BE AVAILABLE.
• THIRD-PARTY MODEL SOURCES WILL REMAIN AVAILABLE.
• DOWNLOADED MODELS WILL ALWAYS REMAIN AVAILABLE OR FUNCTIONAL.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP.

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF DATA, LOSS OF STORAGE, DEVICE PERFORMANCE ISSUES, APPLICATION CRASHES, MODEL FAILURES, OR RELIANCE ON AI-GENERATED OUTPUTS.

THE APP IS PROVIDED FREE OF CHARGE, AND ANY LIABILITY THAT CANNOT BE EXCLUDED IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.

SECURITY

No software can be guaranteed to be completely secure.

You are responsible for maintaining the security of your device, operating system, downloaded models, and any information stored on your device.

CHANGES TO THE APP

We may modify, improve, remove, or add features to the App in future versions.

Features described in documentation may change between releases.

CHANGES TO THESE TERMS

We may update these Terms from time to time.

When updated, the new version will replace the previous version for future use of the App.

The current version will be available in the project's public source repository.

TERMINATION

You may stop using the App at any time by uninstalling it and deleting its stored data and downloaded models.

We may discontinue development or distribution of the App at any time. Because the App is open source, you remain free to use, build, and modify the source code under the Apache License 2.0.

GOVERNING LAW

These Terms do not designate a particular governing law or exclusive forum.

The App is a free, open-source project rather than a commercial service, and any dispute will be determined by whichever law and courts have jurisdiction under the applicable rules in the circumstances.

Nothing in these Terms removes any mandatory legal rights you have under the law of the country where you live, including consumer protection rights.
